Terms of Use — DashFlow

These Terms of Use govern access to and use of the DashFlow platform, published by NICOMATIC SENEGAL.

By creating an account or using DashFlow, you accept these Terms of Use in their entirety. If you do not accept these terms, you may not use the service.

1. Description of the service

DashFlow is an AI-powered business intelligence SaaS platform. It allows users to:

  • Connect data sources (files, databases, third-party APIs).
  • Generate personalized dashboards using artificial intelligence.
  • Visualize KPIs in real time.
  • Collaborate within an organization through groups and differentiated access.

2. Access to the service

2.1 Account creation

Access to the service requires creating an account. You must provide accurate information and keep it up to date. You are responsible for the confidentiality of your credentials.

2.2 Trial period

Every new account benefits from a free trial period. After this period, continuing to use the service requires subscribing to a paid plan.

2.3 Organization accounts

A founding user creates the organization and is its administrator. They can invite other members, create groups and assign roles. The founder is responsible for the use made by members of their organization.

3. Plans and billing

3.1 Available plans

Plans, their limits and prices are defined and updated by NICOMATIC SENEGAL. They are always viewable on the Pricing page of the platform.

3.2 Billing

Billing is monthly, in advance. Renewal is automatic unless cancelled. In case of non-payment, access may be suspended after formal notice.

3.3 Plan changes

You can change plan at any time from your workspace. Upgrading takes effect immediately. Downgrading takes effect at the next billing period.

3.4 Refunds

Amounts already invoiced are not refundable unless otherwise required by law.

4. Data and content

4.1 Your data

You remain the owner of all data you import into DashFlow (files, database data, API data). You grant us a limited licence to process it solely for the purpose of providing the service.

4.2 Use of data

NICOMATIC SENEGAL does not use your data to train third-party artificial intelligence models, resell it or disclose it to unauthorized third parties. See the Privacy Policy for more details.

4.3 Prohibited content

You agree not to import into DashFlow any data that is:

  • Unlawful, defamatory, obscene or infringing on third-party rights.
  • Containing malware.
  • Subject to legal restrictions for which you do not hold the necessary rights.

5. Intellectual property

The DashFlow platform, its code, interfaces, brand and AI models are the exclusive property of NICOMATIC SENEGAL. Any unauthorized reproduction, modification or exploitation is prohibited.

6. Availability and maintenance

NICOMATIC SENEGAL strives to keep the service available 24/7. Interruptions may occur for maintenance (announced in advance where possible) or force majeure. No absolute availability guarantee is given.

7. Limitation of liability

To the extent permitted by applicable law, NICOMATIC SENEGAL is not responsible for:

  • Data loss resulting from incorrect use of the platform.
  • Decisions made on the basis of dashboards and analyses produced.
  • Service interruptions beyond its control.

NICOMATIC SENEGAL's total liability is limited to the amounts actually paid by the user in the 12 months preceding the damaging event.

8. Termination

8.1 By the user

You can cancel your account at any time from your workspace. Cancellation takes effect at the end of the current billing period.

8.2 By NICOMATIC SENEGAL

NICOMATIC SENEGAL reserves the right to suspend or terminate your access in case of breach of these Terms, non-payment or fraudulent use, after formal notice has remained without effect.

9. Changes to the Terms

NICOMATIC SENEGAL may modify these Terms. Any material change will be notified to you by email at least 30 days before it takes effect. Continued use after that date constitutes acceptance.

10. Applicable law and jurisdiction

These Terms are governed by Senegalese law. Any dispute shall be submitted to the exclusive jurisdiction of the courts of Dakar, following an attempt at amicable resolution.
